Air National Texas will provide you with prompt and efficient service. It is expressly agreed that Air National Texas in no event will be liable for damages or loss caused by delay in shipment of materials or any loss arising out of the performance of this agreement.
We shall take all reasonable precautions to avoid injury to persons and damage to property. We shall not be liable for the operation of the equipment, nor for any injuries to persons, nor to damage to property, except those due to negligent acts or omission of our employees and in no event shall we be liable for consequential damages. We shall not be liable for any loss or damages due to delay in furnishing labor or material caused by unusual delays in procuring supplies or for any other cause beyond our control.
Customer represents and warrants that he, she, or it is the owner of the real property wherein goods and services of Air National Texas are being provided, and he, she, or it is authorized to enter into this proposal and agreement.
All sales of equipment or service is to be paid upon completion. If purchase is not paid upon completion, all guarantees and warranties are null and void. If sale is financed, papers are to be signed prior to installation of equipment. If finance papers are not signed and returned to Air National Texas prior to installation, all guarantees and warranties are null and void. It is the normal business practice for Air National Texas to remove old equipment unless otherwise expressed in writing on the front of this contract by the customer.
Air National Texas is not liable for water damage due to clogged drain lines or dirty filters before, during, or after service. Air National Texas cannot be held liable for any assumed warranties once the sold equipment has been touched by another company or unlicensed contractor, which includes and is not limited to the homeowner.
Air National Texas shall not be responsible for normal or existing wear, tear, deterioration, cosmetic damages and/or existing damages to owner’s property for the failure of structural components, including, but not limited to the failure to bear weight of installing personnel and/or equipment and/or any similar or related damages.
This invoice represents a legal and binding contract. Customers are obligated to pay for purchased goods and services at the agreed price. If payment is not received within 30 days of job completion, legal action will be taken for Air National Texas to receive payment/funding. If payment or signed finance papers are not received within 30 days from sale date, Air National Texas will begin the process of attaching a lien on the customer’s property. By the customer signing the front of this contract they agree to Air National Texas attaching a lien to their home to obtain unpaid balances.
All warranties offered by Air National Texas will be honored unless customer does not maintain entire system as recommended by Air National Texas. Air National Texas recommends a bi-annual maintenance performed by a qualified A/C company registered with the State of Texas.
All coupons and/or special offers are applied to book price. Once a sale is finalized, coupons do not apply to the quoted price. All allowable discounts will be taken at the time of sale and cannot be used after service or installation. Cancellations where equipment is already installed will require a restocking fee. By signing the front of this contract, customer agrees with all terms herein.
Air National Texas specifically excludes from obligations under this agreement the performance of all normal maintenance operations (unless shown on the front as part of this agreement) that are, in general, defined by the equipment manufacturer’s installation and service instructions or by the owner’s manual. Said operations include, but not limited to filter cleaning and/or replacement lubrication, belt adjustments and/or replacements, and coil cleaning. Mold guarantee requires media and UV element replacement per manufacturer’s recommendations.
Air National Texas specifically excludes from its obligations under this contract the performance of all service operations that relate to the interruption, inadequacy, irregularity of electrical, gas, and water services to the equipment. Said operations include, but shall not be limited to, the replacement of fuses, the resetting of circuit breakers, the resetting of safety devices, and the relighting of pilot flames.
Air National Texas assumes no responsibility for discomfort, inconvenience, temporary housing, or damage due to high or low temperatures, high or low humidity, or other consequential damage or loss resulting from the failure of the equipment furnished under the terms of this contract.
The customer agrees to keep the work free of all claims and encumbrances until such time that Air National Texas has been fully paid. The customer agrees not to remove any material or equipment from the premises or transfer any interest in material and equipment furnished until such time that Air National Texas has been fully paid without the written consent of Air National Texas.
Title to and ownership of all material, equipment, and accessories covered by this agreement, whether affixed to the customer’s realty or otherwise, shall be considered personal property and be deemed severable without injury to the customer until such time that Air National Texas has been fully paid. In the event the customer fails to make payments when due, the unpaid balance shall become immediately due and payable. Failure for the customer to comply within fifteen (15) calendar days from the date thereof shall be considered just cause and permission for Air National Texas to enter the premises of the property during reasonable hours and without further notice repossess materials, equipment and accessories.
Any alteration or deviation from the scope of work described on the front of this contract that involves extra cost to Air National Texas will be executed on written order and will be an additional cost to the customer above the stated price on the front of this contract.
The customer agrees that all costs, including attorney fees incurred by Air National Texas, in its efforts to collect or to attempt to collect any debt related to the agreement shall be paid by the customer.
The customer agrees to pay interest at the rate of 24% per annum or the maximum the law allows if payment is not received when due. The customer acknowledges that said interest is intended to encourage prompt payment and is not to be considered an offer by Air National Texas to accept installment payments unless an installment agreement has been reached and the installation terms are written out in full on the front side of this contract.
NOTICE: You and your contractor are responsible for meeting the terms and conditions of this contract. If you sign this contract and you fail to meet the terms and conditions of this contract, you may lose your legal ownership rights in your home. Know your rights and duties under the law.
Any dispute or difference arising out of or about this contract shall be determined by the appointment of a single arbitrator to be agreed between the parties, or failing agreement within fourteen days, after either party has given to the other a written request to concur in the appointment of an arbitrator. The arbitrator will be appointed by the president or a vice president of The American Arbitration Association.
Buyers right to cancel: You may cancel this agreement by providing written notice in person or by mail. This notice must indicate that you do not want the goods or services and must be delivered before midnight of the third business day after the date on this contract. If you cancel this contract, the seller will return any down payment. Labor rate will be billed at 50% of regular rate for installation and un-installation of equipment. By signing the front of this contract, customer agrees to those terms. Flex duct work cannot be returned. Any purchase that has labor charges such as diagnostics, rewire, and cleaning cannot be returned.
